Conservation Commission Minutes 09/18/13

Present for the Conservation Commission and attending the meeting were:  Sandy Broyard, Chairman, Candy Shweder, Vice Chairman, Pam Goff, Wesley Cottle, Joan Malkin, Chris Murphy and Chuck Hodgkinson.  George Sourati also attended.  Bob Hungerford was absent.     

The meeting came to order at 12:50 PM.  The site visit was made at 12 noon on September 18th.   

AMENDED ORDER OF CONDITIONS SE 12 – 643; GEORGE SOURATI FOR THOMAS W. ROUSH, TRUSTEE; 39 Spruce Gate Rd.; AP 35-1.14:  Ms. Broyard opened the public hearing at 12:51 PM.  Mr. Sourati reviewed a revised site plan dated 8/27/13 with the following proposed changes to the Order of Conditions issued on 12/9/11:  1. Conduct an archaeological survey of the building envelope, existing driveway and area around the existing well.  A machine-assisted stripping of the topsoil will take place.  2.  Install underground utilities from Spruce Gate Road, down the driveway to the building envelope and from the existing well to the driveway.  The utilities will also cross a culvert under the driveway connecting an intermittent stream.  The activity will take place in the buffer zone of an isolated wetland and the intermittent stream.  The closest driveway work will be two feet from a wetland edge.

Mr. Sourati explained that the Public Archaeological Laboratory (P.A.L.) out of Pawtucket, R.I. will conduct the archaeological survey.  He explained the building envelope of 50,000+ sq. ft. was defined by the Planning Board when the property was subdivided.  The limit of the building envelope is shown in orange on the site plan.  The Commission asked why the entire building envelope must be scraped – in lieu of the building footprint.  Mr. Sourati pointed out that only a section of the building envelope is within the Commission’s jurisdiction.  He added that Doug Cooper evaluated the land abutting the driveway and determined it is a moist drainage way.  

There was much discussion about erosion control measures and Mr. Sourati agreed to have hay bales with silt fencing installed around the entire perimeter of the building envelope.  The Commission also determined that there can be no clearing in the isolated wetland buffer zone south of the existing driveway.  Mr. Sourati agreed and said he will prepare a revised site plan dated 9/18/13 reflecting these changes.  

After much discussion and with no comment from the public a motion was made to close the hearing at 1:05 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the plan as discussed with the following special conditions.  1.  The Amended Order of Conditions shall not be issued until the revised site plan is submitted with the agreed adjustments and approved by the Conservation Agent.  2.  Silt fencing shall be installed along the sides of the driveway for the utilities installation as shown on the revised site plans dated 8/27/13 and 9/18/13 and approved by the Conservation Agent before work begins.

  • Additional silt fencing with staked hay bales shall be installed along the perimeter of the entire building envelope for the archaeological scrape and approved by the Conservation Agent before work begins.  4.  The silt fencing and hay bales along the perimeter of the building envelope shall be maintained in good condition until the re-seeded meadow is fully established – after the archaeological scrape is performed.          5.  Clearing is only allowed in the portion of the isolated wetland buffer zone from the proposed house to the existing driveway and shown on the revised site plan dated 9/18/13.  No clearing is allowed in the isolated wetland buffer zone south of the existing driveway.  The motion was seconded and with no further discussion passed unanimously with six in favor.
 
ADMINISTRATION:  

The September 4, 2013 meeting minutes were reviewed and unanimously approved as presented.
